     A Regular meeting of the Delta County Board of Commissioners was held this date, pursuant to the following call:

     A Regular Meeting of the Delta County Board of Commissioners is scheduled for Tuesday January 19, 2010, at 5:15 p.m. in the Circuit Courtroom of the Delta County Courthouse.

PRESENT:  Commissioners Bengry, Elegeert, Rivard, Ruohomaki and              Schultz.

 

ABSENT:   None.

          The meeting was called to order at 5:15 p.m. in the Circuit Courtroom of the Delta County Courthouse by Delta County Clerk, Nancy Kolich.

 

SPECIAL ORDERS OF BUSINESS:

1.   2010 Board Assignments

       Moved by Commissioner Bengry and seconded by Commissioner Ruohomaki to reappoint Karen Wigand and Commissioner Schultz to the CAA/HRA Board.  MOTION CARRIED. 

       Moved by Commissioner Bengry and seconded by Commissioner Schultz to appoint Robert Berbohm to the U.P. 911 Authority.  MOTION CARRIED.

       Moved by Commissioner Bengry and seconded by Commissioner Rivard to adopt final Board appointments as presented.  MOTION CARRIED.

 

 

 

 

   V.  APPROVAL OF MINUTES OF PREVIOUS MEETING

 

       Moved by Commissioner Ruohomaki and seconded by Commissioner Bengry to approve the minutes of the January 5, 2010 meeting.  MOTION CARRIED.

 

  VI. APPROVAL OF AGENDA

      Moved by Commissioner Bengry and seconded by Commissioner Ruohomaki to amend the agenda adding Committee Reports Item 3. Committee of the Whole meeting minutes of the January 11, 2010.  and adding New Business Item 11. Administrator’s contract.  MOTION CARRIED unanimously.

X.   COMMITTEE REPORTS:

1. Administrator’s Report.    

        7. District Court ASFCME Contract Negotiations.

           Moved by Commissioner Bengry and seconded by Commissioner Ruohomaki to appoint Commissioners Rivard and Schultz to the District Court Contract negotiating team.  MOTION CARRIED.

 

           Moved by Commissioner Bengry and seconded by Commissioner Rivard to receive the Administrator’s report and place on file.  MOTION CARRIED.  

     

2.  Conservation District Report.

         Soil Conservation Quarterly Report was presented by Rory Mattson, Director.

 

         Moved by Commissioner Rivard and seconded by Commissioner Schultz to receive the report and place on file.  MOTION CARRIED.

 

3.  Committee of the Whole meeting minutes of the January 11, 2010.

              Moved by Commissioner Ruohomaki and seconded by Commissioner Bengry to wait to set up a meeting with the governmental entities that would benefit from the Allied Information Solutions proposed project to secure funding until after Masonville Township is completed.  MOTION CARRIED.

 

       Moved by Commissioner Bengry and seconded by Commissioner Rivard to approve the minutes of the January 11, 2010 Committee of the Whole minutes and place on file.  MOTION CARRIED.

 

X. GENERAL ORDERS OF BUSINESS

       5. Emergency Management Coordinator.

          Commissioner Bengry to move into executive session at 5:40 p.m. for the purpose of considering a written opinion letter from Attorney Terry Burkhart regarding the Emergency Management Coordinator contract under OMA 15.262(2)(c)Sec.8(h).

          Moved by Commissioner Ruohomaki and seconded by Commissioner Bengry to reconvene into regular session at 6:18 p.m.  MOTION CARRIED.

 

    Moved by Commissioner Schultz and seconded by Commissioner Rivard to enter into an independent contract with Robert Berbohm as Emergency Management Coordinator retroactive to January 1, 2010 and authorize Administrator Viau to clean up the contract wording to be presented to the Board for final approval.

          MOTION CARRIED.

 

       1.  Payment of Bills.

           Moved by Commissioner Schultz and seconded by Commissioner Rivard to approve payment of the bills in the amount of $599,977.74.  MOTION CARRIED.

 

       2.  Request from Equalization for 40 hour week.

           Moved by Commissioner Schultz and seconded by Commissioner Rivard to approve the Equalization Department request as long as it comes out the Equalization budget.  MOTION CARRIED.  Bengry opposed to the stipulations.

 

       3.  Request from Sheriff to increase part time Road wages.

           Moved by Commissioner Schultz and seconded by Commissioner Bengry to approve the $2.00 per hour increase ($12.00 to $14.00 per hour) in the part time Road Patrol Deputies to be paid from the Road Patrol Fund.  MOTION CARRIED.

 

          4. Conditional/Special Use Fees.

             Moved Commissioner Bengry and seconded by Commissioner Ruohomaki to increase the Conditional/Special Use Zoning Fees to cover costs as recommended by Building and Zoning Director Tim Callahan.  MOTION CARRIED.

          6. Appointment to 911 Authority Board.

        Addressed under Board Appointments.

 

          7. Jail Repair.

             Moved by Commissioner Bengry and seconded by Commissioner Schultz to direct Maintenance Director Steve Carlson and Administrator Viau look into necessary jail repairs and present the Board with a report that includes options and priorities.  MOTION CARRIED.

 

          8. Paul Graber, US Census.

             Assistant Manager for Census in the U.P. updated the Board on the 2010 Census in Delta County.

 

          9. Resolution in Support of the Final Report of the Legislative Commission on Statutory Mandates.

 

              Moved by Commissioner Bengry and seconded by Commissioner Ruohomaki to adopt the Resolution in Support of the Final Report of the Legislative Commission on Statutory Mandates as presented and send to our legislators.  MOTION CARRIED.

 

         10. Executive Session.

             Commissioner Bengry to move into executive session at 6:49 p.m. to discuss the Administrator’s contract under OMA 15.262(2)(c).

               Moved by Commissioner Bengry and seconded by Commissioner Schultz to approve the contact with the agreed upon amendments retroactive to January 1, 2010.

 XII. COMMISSIONERS CONCERN

      Commissioner Bengry: Congratulations Nora. Addressed concerns with the Soil and Sedimentation Fee Schedule timeline.  

 

      Commissioner Rivard: None.

 

      Commissioner Ruohomaki: Compliment the Health Department on the excellent job they did with the H1N1 Flu Clinic.

 

      Commissioner Schultz: Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to have the Administrator review MAC Conference agenda and attend sessions that are pertinent to the county.

 

      Commissioner Elegeert: Thank Commissioners Bengry and Ruohomaki on the fine job they did putting together the Administrator’s contract.
