     A Regular meeting of the Delta County Board of Commissioners was held this date, pursuant to the following call:

     A Regular Meeting of the Delta County Board of Commissioners is scheduled for Tuesday September 4, 2007, at 5:15 in the Circuit Courtroom of the Delta County Courthouse.

ROLL CALL

PRESENT:  Commissioners Bengry, Elegeert, Rivard, Ruohomaki and Schultz.

 

ABSENT:  None.

          The meeting was called to order at 5:15 p.m. in the  Circuit Courtroom of the Delta County Courthouse by Delta County Clerk Nancy J. Kolich.

              

   V.  APPROVAL OF BOARD MINUTES OF PREVIOUS MEETING     

       Moved by Commissioner Schultz and seconded by Commissioner Bengry to approve the minutes of the August 27, 2007 Committee of the Whole meeting.  MOTION CARRIED.

 

  VI.  APPROVAL OF AGENDA

       Moved by Commissioner Rivard and seconded by Commissioner Ruohomaki to approve the agenda as presented.  MOTION CARRIED.

           

 VII.  PRESENTATATION OF WRITTEN COMMUNICATIONS

        A. Received:

           1. Resolution from Ottawa County.

           2. Resolution from Allegan County.

           3. Resolution from Livingston County.

           4. Resolution from Newaygo County.

           5. Letter from Prosecutor in receipt of reimbursement.

 

        B. Forwarded:  

           1. Letter C. Ness re: Pioneer Trail House Expenses.

           2. Letter to Hannahville Indian Tribal Chair.

 VIII. REPORTS OF SPECIAL COMMITTEES AND OTHERS.

        Moved by Commissioner Ruohomaki and seconded by Commissioner Bengry that the Communications and Reports of Standing and Statutory Committees and the Reports of Special Committees and Others be received and placed on file.  MOTION CARRIED.

      

IX.   PUBLIC COMMENT ON AGENDA ITEMS

      Rory Mattson, Executive Director Delta County Conservation District, addressed the Board regarding the Superior Environment Health Code articles appearing in the newspaper – the issue is the service and the process not the environment.

     Diane Matthews, Delta-Menominee County Environmental Health, would like to participate in the evaluation of the Superior Code.

 

 X.  COMMITTEE REPORTS:

1. Administrator’s Report.

        Moved by Commissioner Schultz and seconded by Commissioner Rivard to receive the Administrator’s report and place on file.  MOTION CARRIED.

 

     2. Personnel Committee minutes of 8-23-07 & 8-29-07.

        Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to receive the Personnel Committee minutes and place on file.  MOTION CARRIED.

    

  XI. GENERAL ORDERS OF BUSINESS

 

      A.  UNFINISHED BUSINESS

 B.  NEW BUSINESS

1.  Payment of Bills.

              Moved by Commissioner Rivard and seconded by Commissioner Schultz to approve payment of the bills in the amount of $ 1,063,001.84.  MOTION CARRIED.

 

          2.  Superior Health Code.

              Moved by Commissioner Rivard and seconded by Commissioner Ruohomaki to appoint a Technical Committee consisting of Dennis Bittner, Dave Holmgren, Diane Matthews, Jerry “Pug” Ducette, Bob Zinn, Tom Carviou, Commissioner Schultz and Commissioner Elegeert to evaluate the Superior Code.  MOTION CARRIED.

 

          3.  Hannahville 2% Grant Applications.

              Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to approve the request for a Hannahville 2% Grant application for UPCAP for Juvenile Restorative Justice Program.   MOTION CARRIED.

              Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to approve the request for a Hannahville 2% Grant application for UPCAP Peace Making for Kids Program.  MOTION CARRIED.

 

4.  Lawsuit Final Resolution.

    No action was taken.

 

          5.  Resolution to apply for Brownfield Grants.

              Moved by Commissioner Rivard and seconded by Commissioner Bengry to adopt a resolution giving permission to Commissioner Rivard and Administrator Erickson to work with Flo McCormick from MAC to apply for Brownfield grants on the behalf of Delta County for funding for clean up of several areas.  MOTION CARRIED. 

                   

 XII. GENERAL PUBLIC COMMENT

    None.

 

 

XIII. COMMISSIONERS CONCERNS

      Commissioners Rivard:  None.

      Commissioner Ruohomaki: Bengston lawsuit settlement finalized and the Board will be taking no additional action.

 

      Commissioner Bengry:   Blaming the messenger, messenger had nothing to do with what is going on, in future blame the code and not the messenger.  

 

      Commissioner Schultz:   None.

      Commissioner Elegeert:  None.

 

XIV.  MEETING SCHEDULE.

      Wednesday September 5th Budget Hearing at 5:15 p.m. in the Delta County Circuit Courtroom.

               

      Thursday September 6th Budget Hearing at 10:00 a.m. at the State Office Building Conference Room.

 

      Wednesday September 19th Delta Menominee Health Board meeting 5:30 pm EST at Pinecrest.

      Moved by Commissioner Ruohomaki and seconded by Commissioner Rivard to adjourn at 5:57 p.m.  MOTION CARRIED.
