ROLL CALL

PRESENT:  Commissioners Bengry, Elegeert, Rivard, Ruohomaki, Schultz.

 

EXCUSED:  None.

          The meeting was called to order at 5:15 p.m. in the Circuit Courtroom of the Delta County Courthouse by Delta County Clerk Nancy J. Kolich.

              

   V.  APPROVAL OF BOARD MINUTES OF PREVIOUS MEETING     

       Moved by Commissioner Schultz and seconded by Commissioner Bengry to approve the minutes of the October 16, 2007 meeting   MOTION CARRIED.

 

  VI.  APPROVAL OF AGENDA

       Moved by Commissioner Ruohomaki and seconded by Commissioner Bengry to approve the agenda as amended.  MOTION CARRIED.

           

 VII.  PRESENTATATION OF WRITTEN COMMUNICATIONS

        A. Received:   1. Letter from City of Escanaba

      Moved by Commissioner Schultz and seconded by Commissioner Bengry to receive and place on file.  MOTION CARRIED.

      

IX.  PUBLIC COMMENT ON AGENDA ITEMS  

     Rory Mattson, stated the Soil Conservation District’s support for the Terrace Bay’s request to the DEQ.

 

 X.  COMMITTEE REPORTS:

1. Administrator’s Report.

   Maximus Cost Allocation Plan for Probate Court.

        Moved by Commissioner Bengry and seconded by Commissioner Schultz to approve authorizing up to $5,000 for Maximus to prepare a Cost Allocation Plan for Probate Court for Juvenile Justice and Child Care Fund Programs.  MOTION CARRIED.

 

        Moved by Commissioner Rivard and seconded by Bengry to send a letter to Lansing in conjunction with Prosecutor Parks requesting that MSP Crime Lab in Marquette be kept open.  MOTION CARRIED.

 

       Contract Negotiations.

       Moved by Commissioner Ruohomaki and seconded by Commissioner Schultz to appoint Commissioners Schultz and Rivard to the negotiation team for the Corrections Contract.  MOTION CARRIED.

 

        Moved by Commissioner Ruohomaki and seconded by Commissioner Bengry to approve up to $750 to put an ad in the 2008 Bays de Noc Visitor Guide from Ren Zone Funds.  MOTION CARRIED.

 

        Moved by Commissioner Bengry and seconded by Commissioner Rivard to receive the Administrator’s report and place on file.  MOTION CARRIED.

    

  XI. GENERAL ORDERS OF BUSINESS

 

      A.  UNFINISHED BUSINESS

    

          1. Superior Health Code.

          Drain Commissioner Don Shirley, chair of the Superior Health Code Ad Hoc Committee, updated the Board on the Committee’s progress. 

 

          2. Appointments to Various Boards.

          Moved by Commissioner Ruohomaki and seconded by Commissioner Bengry to reappoint Michael Parrett, Tom Pairolero, Bill Kwarciany, John Winneroski and William Charon to the Building Authority.  MOTION CARRIED.

 

          3. October 16, 2007 Committee of the Whole meeting.

          Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to authorize P.A. Parks and Administrator Erickson to determine the cost to make the temporary position in the prosecutor’s office a permanent position and bring a proposal back to the Personnel Committee.   MOTION CARRIED.

 

          Moved by Commissioner Bengry and seconded by Commissioner Schultz to receive and place on file.  MOTION CARRIED.

 

 B.  NEW BUSINESS

1. Payment of Bills.

          Moved by Commissioner Rivard and seconded by Commissioner Schultz to approve payment of the bills in the amount of $ 728,219.16.  MOTION CARRIED.

 

          2. Adoption of Hire Veterans First Resolution.

          Moved by Commissioner Schultz and seconded by Commissioner Bengry to adopt the Hire Veterans First Resolution as presented.  MOTION CARRIED.

 

          3. Mike Pouliot, request letter of support for Terrace Bay Boat Launch Project.

          Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to authorize a letter of support for the Terrace Bay Boat Launch Project.   MOTION CARRIED.

            

4. County Zoning.

          Building and Zoning Director, Tom Carviou, presented the different zoning options to the Board.  Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to authorize Administrator Erickson to contact CUPPAD to set up a meeting with the township boards to discuss the zoning options with the 2 zoning memorandums to be sent to the townships with the notice of the meeting.  MOTION CARRIED.

 

          Moved by Commissioner Bengry and seconded by Commissioner Bengry to move the Executive Session to the end of the meeting.  MOTION CARRIED.

 

          5. Executive Session re: Labor Contract.

          Moved by Commissioner Rivard and seconded by Commissioner Ruohomaki to move into executive session at 6:41 p.m. to discuss a tentative agreement for the Road Patrol contract.

          Moved by Commissioner Ruohomaki and seconded by Commissioner Rivard to reconvene at 6:47 p.m.  MOTION CARRIED.

 

No actions were taken during executive session.

 

          Moved by Commissioner Schultz and seconded by Commissioner Rivard to approve a 3 year contract with the Road Patrol Bargaining Unit as presented.  MOTION CARRIED.

 

          6. Darrel Bengry Letters.

          District Court line item dispute with Administration.

          Moved by Commissioner Ruohomaki and seconded by Commissioner Schultz to send to the Finance Committee of the Whole to resolve.  MOTION CARRIED.

 

          Administrator Evaluation.

          Moved by Commissioner Rivard and seconded by Commissioner Ruohomaki to send to the Finance Committee of the Whole to discuss the procedure to evaluate the Administrator.  MOTION CARRIED.

 

          7. Planning Commission Case 17-07-PC.

          Case 17-07-PC, Johansson Farm, LLC, Bay de Noc Township. Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to approve the request to rezone from Rural Residential, Timber Production and Resource Production to all Resource Production as recommended by the Planning Commission.

          8. Delta County Soil Conservation Update.

          Rory Mattson, Director Delta County Conservation District, presented an update to the Board on Conservation District projects.  He will present monthly activity reports.

          Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to make the $25,000 allocation in one payment to the Delta County Soil Conservation District with the Director to present monthly activity reports to the Board.  MOTION CARRIED. Rivard opposed.

 

 XII. GENERAL PUBLIC COMMENT

      Connie Ness, Airport Administrator, notified the Board that Great Lakes will not service Delta County, so the USDOT reopened the bids for air service for the four UP Airports effected.  

      Kay Rowlands, thanked the Board who attended the fundraiser that was held by the courthouse employees for the Youth Assistance Program and Veterans Christmas Baskets.  Also, thought the Board overlooked a recommendation from the October 16, Committee of the Whole meeting regarding the hiring of a housekeeper. 

 

XIII. COMMISSIONERS CONCERNS

      Commissioners Rivard:  Thank Administration and Maintenance for the help in furnishing the County Veterans office at the Airport.  MOTION CARRIED.

 

      Commissioner Ruohomaki:  Submit any evaluation forms prior to the Committee of the Whole meeting.

 

      Commissioner Bengry:  Send letter to MAC thanking for their help in saving PILT monies and all they did during the budget crisis in Lansing.  

 

      Commissioner Schultz: Add Health Department Maintenance of Effort to the Committee of the Whole agenda.

 

      Commissioner Elegeert:  None.

 

XIV.  MEETING SCHEDULE.

      Tuesday November 20th Board Meeting at 5:15 p.m. Circuit Courtroom.

 

XV.  NOTICES – December appointments will be made October 16th.

      Moved by Commissioner Ruohomaki and seconded by Commissioner Rivard to adjourn at 6:57 p.m.  MOTION CARRIED.
