     A Regular meeting of the Delta County Board of Commissioners was held this date, pursuant to the following call:

     A Regular Meeting of the Delta County Board of Commissioners is scheduled for Tuesday September 5, 2006, at 5:15 p.m. in the Circuit Courtroom of the Delta County Courthouse.

PRESENT:  Commissioners Bengry, Elegeert, Nelson, Ruohomaki and Schultz.

ABSENT:   None.

          The meeting was called to order at 5:15 p.m. in the Delta County Circuit Courtroom by Delta County Clerk, Nancy J. Kolich.

 

   V.  APPROVAL OF BOARD MINUTES OF PREVIOUS MEETING     

       Moved by Commissioner Schultz and seconded by Commissioner Bengry to approve the minutes of the August 1, 2006 meeting with added information on the grievance and sick leave items.  MOTION CARRIED.

           

   VI.  PRESENTATATION OF WRITTEN COMMUNICATIONS

        A.  Received:

            1. Resolution from Hillsdale County Board.

            Moved by Commissioner Bengry and seconded by Commissioner Nelson that the Board adopt a similar resolution regarding Community Mental Health.  MOTION CARRIED.

 

            2. Obsolete Property Rehab Exemption Application.

            3. Public Notice re: City of Gladstone.

 

        B.  Forwarded: No written communications were forwarded.

            1. Letter to R. Lindstrom re: Property Appraiser.

IX.   COMMITTEE REPORTS:

      1.  Committee of the Whole

          a.  Minutes of 8-8-06.

              Moved by Commissioner Ruohomaki and seconded by Commissioner Nelson to receive and place on file.  MOTION CARRIED.

 

          b.  Minutes of 8-15-06.

              2.a.  Bills and Payroll.

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to pay the bills and payroll.  MOTION CARRIED.

 

              2.b.  Copier quotes.

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to accept the bid by Cooper Office Equipment for $11,586.  MOTION CARRIED.

 

              2.c.  Postage Machine – Treasurer’s office.

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve leasing a Hasler postage machine for the Treasurer’s office for 4 years at a cost of approximately $3,615 a year to be paid from the summer tax collection fund pending review of the contract.  MOTION CARRIED.

 

 

              2.d.  Court Reporters.

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve no admission of wrongdoing by the County Board or the Courts, going back ten years if under $8,000, non-precedent setting, to settle the Court Reporters independent contracting with the Delta County Courts tax and benefit issue.  MOTION CARRIED.                    

 

              2.e.  UPSET Detective pay rate.

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve the letter of agreement with WPPA.  MOTION CARRIED.

 

              2.f.  Memory Card Programming.

              Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to recommend a 2 year contract with the Cities and Townships for programming of the memory cards for $150 per precinct per election with the County Clerk being compensated $75 per precinct per election for programming the memory cards.

              3.a.  Equalization Appraiser position.

              Moved by Commissioner Ruohomaki and seconded by Commissioner Bengry to approve hiring Daina Norden as the Equalization Appraiser.

              5. Delta County Legal Opinion Policy.

Chairman Elegeert relinquished the chair to Vice-Chair Schultz.

               Moved by Commissioner Bengry and seconded by Commissioner Elegeert to recommend seeking the Attorney General’s opinion on whether the County is responsible for legal fees incurred by Commissioner Nelson and Treasurer Sandy Buckland and to recommend a policy for legal opinions for elected officials.

Vice-Chair Schultz relinquished the chair back to Chairman Elegeert.

 

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to receive the minutes of 8-15-06 and place on file.  MOTION CARRIED.

 

          c.  Minutes of 8-29-06.

              Moved by Commissioner Ruohomaki and seconded by Commissioner Schultz to receive and place on file.  MOTION CARRIED.

 

2.        Administrator’s Report.

              A Special Meeting of the Board will be held on September 26 to adopt the 2006-07 Budget and other issues.

 

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to and cancel the October 3, 2006 meeting as there is a statutory meeting on October 10.  MOTION CARRIED.

 

              Moved by Commissioner Schultz and seconded by Commissioner Bengry to receive the Administrator’s report and place on file.  MOTION CARRIED.

    

3.        PERSONNEL AND FINANCE ISSUE.

a.  Temporary Replacement .

              Moved by Commissioner Bengry and seconded by Commissioner Ruohomaki to send a letter of thank you to Lisa Valentine for her years of service to the Delta County Probate Court.  MOTION CARRIED.

 

             Moved by Commissioner Schultz and seconded by Commissioner Nelson to receive and place on file.

1.  Payment of Bills.

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to pay the bills in the amount of $2,829,056.56.  MOTION CARRIED.

 

          2.  Planning Commission Cases 4-06 PC.             

          Case 4-06-PC, Teddy E. Nelson, Nahma Township.  Moved by Commissioner Nelson and seconded by Commissioner Ruohomaki to approve the request to rezone from Residential 2 to Resource Production as recommended by the Planning Commission.

Planning Commission Case No. 5-06-PC.

          Case 5-06-PC, Richard and Rebecca Elsesser, Bay de Noc Township.  Moved by Commissioner Nelson and supported by Commissioner Bengry to approve the request to rezone from Timber Production to Resource Production as recommended by the Planning Commission.

          3.  Resolution for Sportsmen’s Off-Road Vehicle Association of Delta County.

 

              Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve the Resolution for charitable gaming licenses for the Sportmen’s Off Road Vehicle Association of Delta County.  MOTION CARRIED.         

 

          4.  Cost of MICH-tax CD.

              Moved by Commissioner Nelson and seconded by Commissioner Bengry to approve a charge of $350 for Mich-Tax CD’s to the public, as requested by the Equalization Department.  MOTION CARRIED.

 

          5. Birthday wishes for Mary Alice Butler.

          Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to send Mary Alice Butler, wife of previous County Clerk William Butler, Birthday wishes for her 90th birthday on September 17.  MOTION CARRIED.

 

          6.  Vote on Airport/Parks Issue.

              Commissioner Bengry rescinds his vote on the separation of the Airport and Parks Board and casts a no vote.  Commissioner Nelson concurs and rescinds his vote and casts a no vote.

 

XI.  GENERAL PUBLIC COMMENT

     Peter Mark addressed the Board with his concerns regarding governmental immunity.

 

     Airport Manager, Connie Ness, notified the Board that the UP Wilderness Air Tour will be at the Delta County Airport on September 8, 2006.

 

     Kaye Rowlands, AFSCME Chapter Chair, requested clarification of the start date for the Equalization appraiser employee.

 

XII. COMMISSIONERS CONCERNS  

     Commissioner Ruohomaki:  Concerns with the Board meetings not being televised at the times stated to the public.

         

     Commissioner Bengry:     None.

     Commissioner Nelson:         None.

     Commissioner Schultz:  None.

     Commissioner Elegeert: None.
