     A Regular meeting of the Delta County Board of Commissioners was held this date, pursuant to the following call:

ROLL CALL

PRESENT:  Commissioners Bengry, Elegeert, Nelson, Ruohomaki and Schultz.

ABSENT:   None.

          The meeting was called to order at 5:15 p.m. in the Delta County Circuit Courtroom by Delta County Clerk, Nancy Kolich.

 

          Moved by Commissioner Ruohomaki and supported by Commissioner Schultz to approve the minutes of the November 1, 2005 meeting and the December 1, 2005 Public Hearing.  MOTION CARRIED.

           

   VI.   PRESENTATATION OF WRITTEN COMMUNICATIONS

         A.  Received:  No written communications were received.

             1. Thank you letter from Bonifas Art Center.    

         B.  Forwarded: No written communications were forwarded.

 

VII.      REPORTS OF STANDING AND STATUTORY SPECIAL COMMITTEES AND OTHERS

        1. Human Services Board minutes of 10-17-05.

        2. Solid Waste Management Authority minutes of 10-25-05.

        3. Pinecrest Board of Trustees minutes of 10-27-05.

        4. Concealed Weapons Board minutes of 11-08-05.

        5. Airport and Parks Commission minutes of 11-9-05. 

 

        Moved by Commissioner Ruohomaki and seconded by Commissioner Schultz that the Communications and Reports of Standing and Statutory Committees and the Reports of Special Committees and Others be received and placed on file.  MOTION CARRIED.

 

  VIII. PUBLIC COMMENT ON AGENDA ITEMS

        None.

       

  X.   COMMITTEE REPORTS:

     1. Building and Grounds Committee.

        a. Minutes of 11-10-05.

           III.2. Eminent Domain Resolution.

           Moved by Commissioner Nelson and seconded by Commissioner Bengry to adopt the Eminent Domain Resolution as presented.  MOTION CARRIED.

 

           V.1.  County Zoning to Township Zoning.

           Moved by Commissioner Nelson and seconded by Commissioner Schultz to transfer the zoning powers back to the townships, designate $315 per township for the MSU Citizen Planner training sessions along with $10,000 ($1,000 per township) for assistance in formulating a base zoning ordinance.  The County Board will hold a Public Informational Session on the Transfer of Zoning Powers at a meeting on December 20th at 5:15 p.m.  MOTION CARRIED.

          V.2.  Winter Inmate Parking.

    

          Moved by Commissioner Nelson and seconded by Commissioner Bengry to create a special parking lot that will be plowed on the north side of the jail for inmates winter overnight parking.  MOTION CARRIED.

 

           V.4  Refrigerator replacement.

           Moved by Commissioner Nelson and seconded by Commissioner Bengry to approve pay the difference to purchase of a refrigerator for the Courthouse employee lunchroom.  The Courthouse employees held a fundraiser to help cover the costs.  MOTION CARRIED.

 

         

 

 

          V.5.  Veterans Office location.

          Moved by Commissioner Nelson and seconded by Commissioner Bengry to approve the Veterans office to be moved to the Airport.  MOTION CARRIED.

 

          V.6. Norman Arntzen final bill Courthouse $4,000.   

          Moved by Commissioner Nelson and seconded by Commissioner Bengry to approve payment of the Norman Arntzen final bill of $4,000 for the Courthouse addition and remodeling - of the courthouse interior steps.  MOTION CARRIED.

 

          Moved by Commissioner Nelson and seconded by Commissioner Ruohomaki to accept the minutes and place on file.  MOTION CARRIED.

           

2.   Finance Committee.

        a. Minutes of 11-1-05

           III.1. Equalization Grievance.

           Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve payment of a grievance from the Equalization Department for 40 hour week benefits.  MOTION CARRIED

 

           III.2.  AFSCME Grievance.

           Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve the settlement of the Housekeepers grievance.  MOTION CARRIED.

 

           V.1.  Payment of Bills.

      Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to approve payment of the bills.  MOTION CARRIED.

 

           V.2.Payment of Bittner bill in the amount of $2,520.90.

           Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve payment of $2,520.90 to Bittner Engineering for services to comply with MDEQ wetland requirements at the Renaissance Zone.  MOTION CARRIED.

 

           V.4.  CRP Contract.

           Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve the Cooperative Reimbursement Contract for the Delta County Friend of the Court as presented.  MOTION CARRIED.

 V.6.  Maximus Contract.

           Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve the Maximus contract as presented.  MOTION CARRIED.

 

           1.  Building Permit Fee Schedule.

          Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to approve the Building Permit fee schedule increases as presented - $10.00 per type effective January 1, 2006.  MOTION CARRIED.

 

           Moved by Commissioner Schultz and seconded by Commissioner Nelson to receive the minutes and place on file.  MOTION CARRIED.

 

b.  Finance Meeting Minutes of 11-1-05

     1.  Meal Reimbursement without receipts- Commissioner Bengry.

 

     Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve payment of meal reimbursement in the amount of $42.00 without the required receipts to County Commissioner Darrel Bengry, non precedent setting.  MOTION CARRIED.

 

     2.  Meal Reimbursement without receipts - Treasurer Buckland.

       

     Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve payment of meal reimbursement in the amount of $28.50 without the required receipts to County Treasurer Sandy Buckland, non precedent setting.  MOTION CARRIED.

 

     3.  Meal Reimbursement without receipts - Judge G. Pearson.

 

         Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve payment of meal reimbursement in the amount of $41.00 without the required receipts to Judge Glenn Pearson, non precedent setting.  MOTION CARRIED.

 

     V.1.  Payment of Bills.

     Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve payment of the bills.  MOTION CARRIED.

 

     V.2. Credit Card Policy.

     Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve the Credit Card Policy as presented.  MOTION CARRIED.

 

     V.3.  Silver and VanEssen billing $635.76.

     Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve payment to Silver and VanEssen Law Firm in the amount of $635.76 for 911 services.  MOTION CARRIED.

 

     Moved by Commissioner Schultz and seconded by Commissioner Nelson to receive the minutes and place on file.  MOTION CARRIED.

 

3. Personnel Committee.  

        a. Minutes of 12-2-05.

        1.  Prosecutor’s Office Reclassifications.       

        Moved by Commissioner Nelson and seconded by Commissioner Schulz to send to Finance for a final recommendation on reclassification of the Prosecuting Attorney’s Office Administrator and Victim Witness Coordinator employees.  MOTION CARRIED.

        

     3. MERS Resolution on Part-time Employees.

     Moved by Commissioner Bengry and seconded by Commissioner Ruohomaki to approve the MERS Resolution regarding part-time employees as presented.  MOTION CARRIED.

 

     Moved by Commissioner Schultz and seconded by Commissioner Nelson to receive the minutes and place on file.  MOTION CARRIED.

 

4.   Administrator’s Report.           

        Moved by Commissioner Nelson and supported by Commissioner Ruohomaki receive the Administrator’s report and place on file.  MOTION CARRIED.

    

   X. GENERAL ORDERS OF BUSINESS

 

      A.  UNFINISHED BUSINESS

          1.  Appointments

          Moved by Commissioner Bengry and seconded by Commissioner Nelson to re-appoint Michael Parrett and Tom Pairolero and appoint John Winneroski and Bill Charron to the Building Authority Board.  MOTION CARRIED.

 

          Moved by Commissioner Schultz and seconded by Commissioner Ruohomaki to re-appoint Brent Lantagne to the Airport and Parks Board and Howard Haulotte to the Planning Commission.  MOTION CARRIED.

 

          Moved by Commissioner Bengry and seconded by Commissioner Nelson to send Cliff D’Arcy a letter of thank you for his years of service to the Planning Commission.  MOTION CARRIED.

 

 B.  NEW BUSINESS

1.  Payment of Bills.

          Moved by Commissioner Nelson and seconded by Commissioner Schultz to approve payment of the bills in the amount of $3,032,648.42.  MOTION CARRIED.

 

     2.  Designate Dispatch Authority Alternate.

          Moved by Commissioner Ruohomaki and seconded by Commissioner Nelson to appoint Commissioner Bengry as the alternate to the Dispatch Authority Board.  MOTION CARRIED.

 

          3.  Approval of Runway Plans for Delta Co. Airport.

          Moved by Commissioner Bengry and seconded by Commissioner Nelson to approve the Runway Plans for the Delta County Airport pre-application.  The County share would be $25,000.  MOTION CARRIED.

 

     4.  Ratification of Lease Agreement with Federal Express.

          Moved by Commissioner Ruohomaki and seconded by Commissioner Schultz to ratify the Lease Agreement with Federal Express at the Airport for 10 years as presented.  Commissioner Nelson abstained.  MOTION CARRIED.

    

    5.  2006 Borrowing Resolution.

    Moved by Commissioner Nelson and seconded by Commissioner Bengry to adopt the 2006 Borrowing Resolution as presented.  MOTION CARRIED.

 

    6.  Accept 2006 Police Vehicle Bid.

    Moved by Commissioner Schultz and seconded by Commissioner Nelson to approve the 2006 Police Vehicle Bid as presented.  MOTION CARRIED.

 

    7.  Request from Commissioner Ruohomaki to attend 12-7-05 meeting.

    Moved by Commissioner Bengry and seconded by Commissioner Nelson to approve Commissioner Ruohomaki and the Chair of the Planning Commission to attend Planning Commission training at a cost of $35 per person.  MOTION CARRIED.

    

         8.  Executive Session.

         Addressed in open session:

         Administrator Erickson addressed the Board with his concerns with the County Treasurer circumventing the Administrator by sending a letter to the Board regarding an Administrator’s employee.  Moved by Commissioner Nelson and seconded by Commissioner Ruohomaki that the Administrator send a letter to Department Heads stating that the Administrator carries out the policies set by the Board.

     Moved by Commissioner Bengry and seconded by Commissioner Nelson to convene into executive session at 7:03 p.m. to discuss pending litigation with Bark River Township.

     Moved by Commissioner Bengry and seconded by Commissioner Nelson to reconvene into regular session at 7:14 p.m.  MOTION CARRIED.

 

No actions were taken during closed session.

 

Moved by Commissioner Nelson and seconded by Commissioner Ruohomaki to submit a letter to the Prosecuting Attorney asking if the Township appointment to the Dispatch Authority is a conflict of interest because he also a party to the lawsuit filed against the Dispatch Authority.  MOTION CARRIED.

 

Moved by Commissioner Ruohomaki and seconded by Commissioner Nelson to hire Attorney Douglas VanEssen to represent the County in the Bark River lawsuit.  MOTION CARRIED.

 XII.  COMMISSIONERS CONCERNS

 

Commissioner Bengry:  Stated different Hannahville grants that                          were awarded.
